</p><p>A state judge this week ordered the University of Virginia <a href="http://www.atinstitute.org/court-orders-university-of-virginia-to/">to stop stonewalling</a> on a Freedom of Information Request for emails from Michael Mann, the creator of the <a href="http://climateaudit.org/multiproxy-pdfs/">much</a>-<a href="http://www.realclimate.org/index.php/archives/2005/02/dummies-guide-to-the-latest-hockey-stick-controversy/">disputed</a> “Hockey Stick” reconstruction of historical global temperatures.</p>
<p>The American Tradition Institute filed the FOIA more than 4 months ago, but the University repeatedly delayed the release of the documents, in apparent violation of Virginia’s FOIA law. On May 16, ATI initiated legal proceedings to force the University to comply with its statutory responsibilities. Only then did the University agree to produce all relevant documents by August 22, a commitment to which the University is bound by this week’s ruling.</p>
<p><span id="more-8900"></span>The parties still disagree on which documents are subject to the FOIA. University of Virginia president Teresa Sullivan <a href="http://www.washingtonpost.com/blogs/virginia-politics/post/u-va-says-it-will-exercise-available-exemptions-on-climate-change-records-request/2011/04/27/AF3V42zE_blog.html">has promised to fight to keep certain documents from ATI</a>, in the interests of “academic freedom.” Under the terms of yesterday’s court order, ATI’s counsel must have access to all documents, even the ones the University is trying to withhold, by September 21. The ultimate fate of these disputed documents likely will be adjudicated by the courts.</p>

</p><p>Thomas Jefferson is renowned as a true Renaissance Man. He was a master of letters, music, architecture, biology, government…and mountaintop removal.</p>
<p>I only learned of this fact recently, on a delightful revisit to Monticello, TJ’s famed estate in Albemarle County. Every school kid in Virginia visits Monticello, repeatedly, so I’d been there several times already. As this was the first time I’d gone since I was in school, this was the first time I paid attention to the exhibits. Thus I learned that Mr. Jefferson <a href="http://www.monticello.org/site/jefferson/timeline-jeffersons-life">removed Little Mountain’s little mountaintop</a> in order to accommodate his mansion.</p>
<p><span id="more-8433"></span>I wonder if the Sage of Monticello could build Monticello today. The EPA is cracking down on mountaintop removal mining in Appalachia, illegally and against the will of elected officials, so as to protect an insect that lives for a day, which isn’t an endangered species. (That’s an outrageous subject I discuss <a href="http://www.scribd.com/doc/48816594/William-Yeatman-EPA-Guilty-of-Environmental-Hyperbole">here</a>, <a href="../../../../../2011/05/09/sierra-club%E2%80%99s-%E2%80%9Cbeyond-coal%E2%80%9D-campaign-is-beyond-the-pale/">here</a>, and <a href="../../../../../2011/02/02/obama-administration-plans-second-front-in-war-on-appalachian-coal-production/">here</a>.) Even if he received the necessary permits, he’d still have to do battle with environmentalists and NIMBY-types. Sadly, I doubt he’d win.</p>

</p><p>Citing the potential for “financial harm,” the University of East Anglia last week <a href="http://climateaudit.org/2011/04/25/cru-refuses-foi-request-for-yamal-climategate-chronology/#more-13528">denied</a> a Freedom of Information request by “Hockey Stick” debunker Stephen McIntyre for the controversial Yamal temperature data. This is the third time he has been rebuffed by the University, which was scandalized by last year’s Climategate controversy over, among other things, inappropriate avoidance of FOI requests.</p>
<p>The University of Virginia last week said it will use &#8220;<a href="http://www.washingtonpost.com/blogs/virginia-politics/post/u-va-says-it-will-exercise-available-exemptions-on-climate-change-records-request/2011/04/27/AF3V42zE_blog.html">all available exemptions</a>” to avoid having to turn over documents related to debunked “Hockey Stick” creator Michael Mann in response to a Freedom of Information Act request by the American Tradition Institute. This stands in stark contrast to the <a href="http://www.nationalreview.com/planet-gore/55940/uvas-double-standard-climate-scientists/edward-john-craig">University’s treatment of Dr. Patrick Michaels</a>, a climate skeptic. When Greenpeace asked filed a FIOA for <em>his</em> records, the University was willing to comply readily.</p>
